Future DOS R&D Inc. (FDOS) and its division, the Energy Communications Management eXchange® (ECMX®), are committed to protecting your privacy and the privacy of our clients. The objective of this Privacy Policy is to describe FDOS and ECMX’s practices pertaining to the collection, use and disclosure of information that may be provided through access to or use of the ECMX Registry™ and its WEB based services (Website). The Privacy Policy makes references to ECMX throughout the document. This Privacy Policy applies equally to ECMX and to FDOS.

Personal and Company Information and its Use

“Personal Information” means information about an identifiable individual. “Company information” means information about an identifiable company that may be affiliated with an individual. Examples of information collected by ECMX are contact information ( e.g., personal and company names, addresses, e-mail addresses and telephone numbers) and financial/billing/shipping information ( e.g., credit card details and credit history). ECMX may use this information for, but not limited to, the following purposes:

  • to provide timely and reliable services including “What Is” and “Who Is” directory services, training services, TDL registration and validation, device class registration, node name registration, security mechanism registration, electronic serial number registration, network access and namespace registration, XML schema generation and documentation byproducts;
  • to communicate with you regarding customer support, account management and billing, verifying credit, customer authentication and related services;
  • to develop and improve our Website and to advise you about new services that may be of interest to you; and
  • to assist law enforcement agencies, to collect outstanding debts, to protect our business interests and the interests of our customers, and to generally meet requirements imposed by law.

Disclosure of Personal Information

Without your explicit consent, ECMX will not sell, share, license, trade or rent your Personal Information to others. ECMX reserves the right to co-operate fully with local, provincial, state and federal authorities in any investigation relating to any Personal Information (including private electronic communications transmitted on the Website) or in support of investigation of unlawful activities. ECMX reserves the right to disclose and/or transfer Personal Information to a third party in the event of a proposed or actual sale, merger or other transfer of the assets or shares of ECMX and/or FDOS, provided that the third party agrees to adhere to the principles expressed in this Privacy Policy and the information does not constitute all or substantially all of the assets being transferred.

Disclosure of Company Information

Without your company’s consent, ECMX will not sell, share, license, trade or rent your Company Information to others. Cookies

A cookie is a small file containing information that a website creates when you visit it. A cookie may be used to track how and when you use a website and/or other websites visited. There are two common types of cookies: “session cookies” and “persistent cookies”. Session cookies store information only for the length of time that you are connected to a website – they are not saved on your computer. Once you leave the website, the originator of the Session cookies no longer has the information that was contained in it. The information stored in “persistent cookies” is written onto your computer hard drive and remains there until the expiry date of the cookie.

The ECMX Registry Website uses session cookies as an additional security feature. When you log on to the Website and are authenticated through your user name and password, a cookie will store the identification number of your browser. Throughout your web session, the session cookie acts as a type of digital signature to identify your current session and activity to the web server. The web server will monitor the number of your browser to ensure that at all times, during your session, we are dealing with you. ECMX uses that information to determine the type of information and/or service that you are looking for on our Website.

Currently, ECMX does not use persistent cookies to store information, but it may do so in the future to manage your service access profile.

For the ECMX Registry to operate, your browser must be set to accept cookies.

How We Protect Your Information

ECMX makes all commercially reasonable efforts to ensure that Personal Information and/or Company Information collected from you is protected against loss and unauthorized access. Access to your Personal Information is restricted to selected ECMX employees or agents. In addition, ECMX employs generally accepted information security techniques, such as firewalls, access control procedures, cryptography, and backup procedures to protect your information against loss and unauthorized access.

Retention of Information

ECMX retains your Personal Information and/or Company Information for as long as necessary to fulfill the purpose for which it was collected and to comply with applicable laws. This period may be indefinite.

Links to Third Party Sites

This Website may offer links to other websites. You should be aware that operators of linked websites may also collect your personal information (including information generated through the use of cookies) when you link to their websites. ECMX and FDOS are not, and shall not be held responsible for the conduct of the third parties or the information that they may collect, or use, or disclose. So it is important to familiarize yourself with their privacy policies before providing them with your Personal Information and/or Company Information.

ECMX may remove links to other websites if it suspects or determines that the other websites ar inconsistent with ECMX’s Privacy Policy or its Terms and Conditions policy. The decision whether to remove a link to another website from the ECMX Website is governed strictly by ECMX and FDOS.

Changes to this Privacy Policy

ECMX may update the Privacy Policy from time to time. When the policy changes in a material way, a notice will be posted on our Website along with the updated Privacy Policy.
